Acting on behalf of ACF, EDO lawyers argued that the Environment Minister’s decision not to apply the water trigger was unlawful. Now, the Federal Court has agreed.
This significant decision also has wider implications – meaning any future Queensland large coal mine proposal cannot avoid tough scrutiny for its impacts on water by creating separate projects for its water pipeline.
